These terms govern your use of recallcrew.com, operated by PeakGen Consulting LLC, doing business as RecallCrew. By using this website you agree to them. If you do not agree, please do not use the site.

1. About us

recallcrew.com is operated by PeakGen Consulting LLC, a limited liability company based in Hoover, Alabama. “RecallCrew” is a trade name of PeakGen Consulting LLC. In these terms, “we” and “us” mean PeakGen Consulting LLC.

2. What this website is

This website describes our services for independent dental practices and lets you request a free revenue report. It is informational. Nothing on it is an offer capable of acceptance, a contract for services, or professional, legal, financial or clinical advice.

If you become a client, the services we provide are governed by a separate signed services agreement, together with a Business Associate Agreement. Where anything on this website differs from your signed agreement, the signed agreement controls.

3. The free revenue report

The revenue report is an illustration, not a forecast, a valuation or a promise of results. It is calculated entirely from the figures you enter, using the following published assumptions:

• If you select “Not sure” for overdue patients, we estimate 25% of your active patients
• Patients returning is estimated at 5% of overdue patients
• First-visit value is estimated at $255 per patient, being a cleaning at $155 plus an exam at $100 at national average fees
• Yearly value is estimated at $510 per patient, being two cleanings and exams a year

These assumptions are shown on the report itself. Your own fees, your patient list and your results will differ, and may differ substantially. The report excludes x-rays, treatment and any other production. You should not rely on it as the sole basis for any business decision.

4. Our guarantee

Our 90-Day Guarantee is described at recallcrew.com/guarantee and applies only on the terms set out there and in your signed agreement. Nothing on this website extends it.

5. Using the site

You agree not to:

• Submit false information, or someone else’s contact details without their permission
• Submit patient names, records or any other patient information through this site
• Use the site unlawfully, or to interfere with its operation or security
• Use automated means to access, scrape or submit to the site, except for search engine and AI crawlers obeying our robots.txt
• Copy, resell or republish the site’s content without our written permission

6. Our content

The text, design, graphics and other material on this website are owned by us or our licensors and are protected by intellectual property laws. The RecallCrew and PeakGen names and logos are our trade marks. You may view and print pages for your own business use. Any other use requires our written permission.

Sample materials shown on this site, including the sample postcard and the sample Monday scorecard, are labelled as samples. Names, figures and the telephone number shown on them are fictional and are for illustration only.

7. Links to other sites

Where we link to a third-party site, such as our scheduling provider, we do so for convenience. We do not control those sites and are not responsible for their content or their privacy practices.

8. Disclaimers

The website and the revenue report are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the site will be uninterrupted or error free, or that the estimates it produces will prove accurate.

9. Limitation of liability

To the fullest extent permitted by law, PeakGen Consulting LLC and its members, officers and personnel will not be liable for any indirect, incidental, special, consequential, punitive or exemplary damages, or for any loss of profits, revenue, data, goodwill or business opportunity, arising out of or in connection with your use of this website, even if advised of the possibility of such damages. Our total aggregate liability arising out of or in connection with this website will not exceed one hundred US dollars ($100). Nothing in these terms limits liability that cannot be limited by law.

10. Indemnity

You agree to indemnify and hold harmless PeakGen Consulting LLC from any claim, loss or expense, including reasonable legal fees, arising from your breach of these terms or your misuse of this website, including any submission of patient information to it.

11. Governing law and disputes

These terms are governed by the laws of the State of Alabama, without regard to its conflict of laws rules. You and we agree that any dispute arising out of or relating to this website or these terms will be brought exclusively in the state or federal courts located in Jefferson County, Alabama, and each party consents to the jurisdiction of those courts.

12. Changes

We may update these terms from time to time. The effective date at the top of this page shows when the current version took effect. Continuing to use the site after a change means you accept the updated terms.

Text-messaging program terms

These terms apply to the RecallCrew text-messaging program, which you join by ticking the optional consent box on our revenue report form.

How to join

Tick the consent box on the revenue report form at recallcrew.com/report and provide your mobile number. The box is unticked by default. Consent is not a condition of purchase, and you will receive your report whether or not you join.

What you will receive

Messages about your revenue report and about RecallCrew’s services, including marketing messages. Messages may be sent using automated technology. Every message identifies RecallCrew as the sender.

Message frequency

Message frequency varies.

Cost

We do not charge for the messages. Message and data rates may apply, depending on your mobile plan.

How to stop

Reply STOP to any message to be removed. You will receive one confirmation message and then no further messages, unless you join again.

Carriers

Mobile carriers are not liable for delayed or undelivered messages. Supported carriers may change.
